Colorado Lawsuit Could Set Up A Takedown Of The Marijuana Industry

A Colorado couple says having a cannabis business as a neighbor hurts their property's value — and they've taken their case to federal court.

A federal lawsuit in Colorado could have some major repercussions for the marijuana industry. 

A couple who lives next door to a marijuana grow facility claim that odors from their neighbor's business have lowered their property's value. They're using an anti-racketeering law to try to prove their case, arguing that the facility is a criminal enterprise that's caused property damages.

An attorney for the defendant told The Associated Press that while he thinks the jury will side with his client, these types of cases can be costly for marijuana businesses. 

Even though marijuana has been legalized in Colorado, it's still illegal at the federal level. So if the jury sides with the plaintiffs, it could set up future cases in an attempt to take down the state's marijuana industry. According to the AP, similar lawsuits using the same strategy have already been filed in other states. 

The trial started Monday and, according to the docket, is expected to last until Friday.
