A federal judge dismissed a defamation suit by Stephanie Clifford, aka Stormy Daniels, against President Donald Trump on Monday.
Daniels' lawyer filed a notice of appeal with the Ninth Circuit Court the same day.
Daniels sued Trump for defamation after he said she lied about being threatened to keep quiet about her alleged affair with him.
He called her claim "a total con job" back in April. Monday, the judge said Trump's speech against her was protected under the First Amendment.
Monday's case is separate from Daniels' other, primary case against Trump and his former attorney Michael Cohen.
